Magicforest®, LTD 2022 Terms and Conditions

 

Terms and conditions are communicated to the customer via catalog, pricelist & order form. By placing your Order with Magicforest, you agree to these terms and conditions:

 

Pricing: Prices are valid through Jan 9th, 2023.

 

Order Requirements:

  • Minimum opening order $250 per brand. Reorders $100 per brand. Orders from multiple brands may be combined to meet these minimums only if Magicforest regularly stocks those brands in one of its domestic warehouses.
  • Items not ordered in case pack quantities will incur a per-piece surcharge of one dollar ($1).

 

Payment Terms:

  • First order is prepaid with Visa or MasterCard. Net 30 terms granted with approved credit (please allow 1-3 weeks for credit approval).
  • For open account terms, we accept checks drawn on US bank accounts or by wire transfer (ACH & SWIFT). Invoices paid with credit card or wire transfer more than seven (7) days after order shipment or at the end of invoice term will incur a 3.5% convenience charge.
  • Past due accounts are subject to a 2% finance charge per month, 24% annually, on the unpaid balance and forfeit all freight allowances and discounts.
  • Delinquent accounts may be sent to collections. Purchaser agrees to pay all collection and legal fees on unpaid balances. 

 

Special Orders:

  • Magicforest may, at its discretion, place special orders for customers for products that are not in the US catalog. Once approved, these special orders cannot be cancelled.  Products from brands not regularly stocked in a Magicforest domestic warehouse are considered special orders and are subject to these terms as well.
  • · Initial order requires prepayment of fifty percent (50%) when special order is placed. Balance to be charged at the time of shipping.

 

Freight:

  • FOB Portsmouth, NH 03801.
  • · Full Freight Allowance (FFA) programs begin at $950 to the contiguous USA. FFA for AK, HI, PR & Canada will qualify to a freight forwarder located in the contiguous US. Certain catalog items incur shipping charges that are not included in the FFA programs, though the cost of the item may be used to reach the $950 FFA level. There is a flat shipping fee of $20 per item or actual freight cost, whichever is lower. Invoices must be paid within terms to receive ANY discounts, including FFA. 

 

Backorders

  • All backorders under $100 will be cancelled unless previous arrangements have been made.
  • All backorders will be cancelled at the end of the year unless previous arrangements have been made.
  • All backorders will be shipped with the same terms as the original order.

 

Shipping Claims/ Credit Request:

  • Shipping claims for damages or shortages must be made in writing within ten (10) days of receipt of your order. Should an item be damaged or have a defect, customer must submit photo(s) to receive credit. Customer will be notified in writing about the status of their request. No credits may be taken without written notification from Magicforest. Photos must be submitted for all physical defects/damages to receive credit.
  • A Return Authorization Number (RA#) is required for all returns. Customer must fill out Magicforest RA# Form or send detailed request in writing with photos before an RA# will be issued. Customer is responsible for all return freight charges unless product is defective, was shipped by mistake or generally the fault of Magicforest. Upon receipt & inspection of the returned items, a 20% restocking fee will be charged to items returned in sellable condition. Items returned with missing parts, damaged packaging or otherwise in unsellable condition will not receive credit.
  • Refunds are not typical; however, there are no refunds on credit card purchases after 120 days of invoice.

 

Warranty / Guarantee: Magicforest stands behind the quality of all of our products. Our products are carefully checked to make sure they leave our warehouse exactly as intended. If a defect in manufacturing or workmanship is found, please notify us immediately and we will replace the item or issue credit. We may ask for the defective item back so we may examine it.
